1. Scope of application

These General Terms and Conditions (GTC) apply to all contracts concluded between JASPORT Brands Holding GmbH and customers via our online shop. Customers can be consumers or businesses.

The presentation of products in the online shop does not constitute a legally binding offer. By submitting your order, you submit a binding offer. Acceptance occurs via email confirmation or shipment of the goods within three business days.

3. Right of withdrawal and return conditions

Consumers have a statutory right of withdrawal of 14 days. In addition, we voluntarily grant an extended right of return of 30 days for unused, complete, and originally packaged goods. Free returns within Germany, the Netherlands, Poland, Belgium, Austria, and the Czech Republic.

4. prices and payment conditions

All prices include VAT. Payment methods are listed in the shop. Payment is due upon conclusion of the contract.

5. Delivery and Delivery Times

Delivery will only be made to the delivery address specified by the customer during the ordering process.
Order processing: 1-3 business days (excluding weekends/public holidays)
Delivery time: 2-5 working days (within Germany), 4-7 working days (other EU countries)

6. Retention of Title

The goods remain our property until full payment.

7. Liability for defects (warranty)

The statutory warranty rights apply. Businesses have a limitation period of one year, and consumers two years from receipt of the goods.

8. Liability

Unlimited liability applies in cases of intent, gross negligence, and injury to life, body, or health. In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations).

9. Dispute Settlement

The EU Commission offers a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/ We do not currently participate in dispute resolution proceedings before a consumer arbitration board.

10. Place of jurisdiction and choice of law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For businesses, the place of jurisdiction is Seevetal, unless another statutory place of jurisdiction applies.
